During the State of the Union Address on January 27, 2010, President Obama took the unprecedented step of overtly criticizing the Supreme Court for its recent decision in Citizens United v. Federal Election Commission, in which the Court upheld political speech protections in the First Amendment by rendering invalid a prior prohibition on independent expenditures by unions and corporations, a prohibition which served to chill political speech.
Furthermore, the president’s attack was facially and factually incorrect, his accusation before a joint session of Congress and the American people turning on an obvious misinterpretation of Justice Anthony Kennedy’s majority opinion.
Worse yet, as the Justices of our nation’s highest court could only sit without reaction, House and Senate Democrats in all directions shot to their feet, applauding wildly at the assertion that the Court was somehow wrong to preserve a fundamental right enshrined in the First Amendment.
