Berg v. Obama Update — Friday, September 5

Obama, DNC Served Yesterday Afternoon

Illinois Sen. Barack Obama was served with papers yesterday connected with the lawsuit filed more than two weeks ago in federal court in Philadelphia questioning his constitutional eligibility for the American presidency. Service was made at his Washington, D.C. Senate office at approximately 1:00 p.m.

From a press release provided by filing attorney Philip Berg and available on his Web site:

Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s eligibility to serve as President of the United States, has received confirmation from his Process Service Company that the Democratic National Committee (DNC) and Senator Barack Obama were served today, September 4, 2008, with the legal documents pertaining to Berg vs. Obama, Civil Action No. 08-cv-4083.

The DNC was served at 12:00 p.m. and Senator Obama was served at 1:00 p.m. The U.S. Attorney’s Office accepted service on behalf of the Federal Elections Committee (FEC) on or about August 22, 2008.

A telephone call to Obama’s Senate office in Washington, D.C. yielded no official comment, as his staffer maintained that she was “not familiar with any legal action” and, even though I mentioned that service was made in D.C. to that office, it was “probably a campaign-related issue.”

The subsequent call to the senator’s campaign headquarters, however, yielded the same result but in a more entertaining fashion.

“That’s very interesting,” said a campaign official who declined to provide a name and admitted that this was the first he had heard of Berg’s lawsuit. He asked whether anything about the civil action had appeared in the newspapers, and when told that the story had appeared in the Washington Times, he laughed.

“Has the story appeared in the New York Times? How about the Washington Post? Or the Los Angeles Times? The Chicago Tribune?” he asked. “Those are all more trustworthy papers than the Washington Times. When the story appears there, then we might have something to say about it.”

“If Sen. Obama were ineligible to run for president,” he said, “I think we would have heard about it by now.”

Berg, over the phone, mentioned that he has received phone calls and advice from dozens of lawyers across the country, and was currently working on preparing a motion for expedited discovery to be filed before the next conference with Judge Surrick. While he was unable to provide a copy of the affidavit of service–as soon as I get a copy, it will be posted here–he was more than happy to offer his perspective on the predictable response I received from Obama’s senate office and campaign headquarters.

“They know about it,” he said, noting that the story has catapulted across the Internet and radiowaves, citing 7.9 million hits on his Web site and mentioning that he is booked for a pair of radio interviews this evening, and will be sitting with a newspaper photographer for another story to appear in the [Norristown, PA] Times-Herald. “Too many times, a lawsuit can be filed and nobody knows about it. This time, the political people must know for sure.”

“The silence is proving me right,” he said, wondering why no doctor or nurse has come forward to claim the inevitable publicity which would accompany an admission that they were in attendance for the Illinois senator’s birth. “I think it’s an insult to the American public and even more so to his campaign supporters who have worked so hard and donated so much money. All they’re doing is prolonging the agony. If I’m right and they stay quiet, they could sit on it for 60 days, get elected, and the only way out would be impeachment by this do-nothing Congress.”

“What does that do for America?” He asked. “This deserves a comment one way or another.”

    Obama = Born in Hawaii after it became a state, case closed. Oh wait, someone will say “where’s the proof? where’s his BC?” Um, I’ve seen several sites show it to prove it to you. But wait “Thats not good enough, government employees aren’t careful in their jobs, blah blah blah” …this is a farce and obviously a hate site.

    You obviously have no clue about US law. Only one parent must be a US citizen for the child to be a citizen and that child does not have to be born in the US. Do your research before spouting off stupidity. If this were not the case, then thousands of US Military personnel overseas would be fighting to have the children born on US military bases in foreign countries nationalized.

    Obama’s mother is a US citizen, that is a known fact, since her parents are US citizens. Hence, her son is a US citizen even if he was born in the buttcrack of Saudi Arabia. Only a true dumbfuck with no clue as to how US laws and statutes actually work would even prescribe to this shitcan conspiracy theory.

    No wonder the Obama campaign won’t respond. You’re hurting McCain-Palin ticket more than helping you fucktards.

    EVERYBODY!!! Please take the time to read the court documents before spewing your profanity from one end of the blog to the other!
    From what I read, he was born in Kenya, flown to Hawaii and registered there four days after birth. His mother as a US citizen was too young to confer her own citizenship upon him.
    Time for the government to get truly involved and settle this thing once and for all!
    If the mainstream media does not get involved quickly, and Obama gets past this with no effort, then I must assume he either owns mainstream media or his campaign people have them under their thumbs as the have Hillary Clinton! (money is power???)

    The issue is more than Birth certificate. I agree he may HAVE BEEN natural born but One way to LOSE citizenship is to voluntarily give it up. He may have unwittingly qualified for this loss when he moved to Indonesia. He has Indonesian citizenship. He traveled in his twenties on an Indonesian passport.
    Indonesia does not allow dual citizenship so in order to get a passport from Indonesia you can’t be a citizen of another country and it is likely that he would be required to forgoe US citizenship.
    You can get US citizenship BACK..if you apply..(re-)naturalization procedure,– which has to happen within 5 yrs ).but he didn’t do that.( travelled in 20′s as Indonesian.) So he can be senator.. he has ONE condition that quaifies for senator..but not the TWO you need for POTUS.

    Obama’s registration to Fransiskus Assisi School In Jakarta, Indonesia which clearly show that he was registered under the name “Barry Soetoro” and his citizenship listed as Indonesian. Indonesia does not allow dual citizenship. So he technically had to lose his US citizenship at some time. He still has a way to regain…1. To come back …the US requires a renunciation of prior citizenship as part of the (re-)naturalization procedure, which has to happen within 5 yrs ) and remember—He traveled in his twenties on an Indonesian passport.So he didn’t do that. Even with a BC , there is enough iffyness here that it deserves a better look.

    Parents cannot renounce U.S. citizenship on behalf of their minor children. So there another knife edge here…( but kids don’t need passports..so..at some point Obama had to be a Ind. citizen legally to get a legal Ind.passport……and hence can’t be dual. And hence had to renounce USA. There’s room for doubt here guys.

    Indonesia does not allow dual citizenship. So he technically had to lose his US citizenship. to get the Ind.passport he used during his 20′s. hence had to renounce USA voluntarily through some declaration…That might haunt him.
    The BC may not be as important as this.
    1.State Department, could reverse the 1990 policy under which Americans are presumed to have intended to keep their US citizenship in the absence of definitive evidence to the contrary.
    ( Since Indonesia denies DUAL. You would have renounced US to get Indonesia passport.)This could be evidence to the contrary.
    hence he may be in trouble..NOT for senate…but for extra requirement for POTUS

    There was an interview with a friend of his mother’s in Washington State who was discussing Stanley Ann having visiting her with little Barry a couple of weeks after his birth on her way back to Hawaii. Why was she flying all over the place with a two week old baby? Where was she coming from? That lady is still living and her interviews are posted on the Web.

    There are also reports of a Barack Hussein Obama being born in Canada in August 1961. How many Barack Obama’s were born in August of 1961? For you doubters, maybe if he didn’t have a father who was a Citizen of a British Colony at the time, and under British Law, this wouldn’t be an issue.

    How many 1/2 white, 1/2 black babies were born in 1961? You would think someone would remember. At least show us a record of birth from the hospital in which he was born. Even with that however, I’m afraid he fails the test.

    The real issue is not whether born in Hawaii. even if he was ( doubt exists)
    The issue is …did he still retain USA citizenship upon going to Indonesia.?( and thereby having to cancel USA cit’ship to qualify,since Indonesia doesn’t allow dual cit’ship.) upon his return to america , he would qualify for senate..but not POTUS. The judge would have to declare that he didn’t intend to give up his USA cit’ship…’cause he was young..

    I dont see the humor. I go to county building to do business and they send me home to get my birth certificate. I have to go to safe deposit box to get and drive back to county office…blah blah blah. YOU MEAN TO TELL ME THAT A CANDIDATE FOR PRESIDENCY SHOULDN’T HAVE TO DO THE SAME THING…WHAT’S THE BIG DEAL??     It certainly is reassuring to know that the privilege of driving a car is more closely guarded than the privilege of becoming Commander in Chief of the United States.

    It would be SO very easy to get the suit dismissed if it were unfounded. Send a lawyer and a staffer to Philly with docs in hand.. boom… DISMISSED. But that hasn’t happened. Just makes you want to ask “Why not?”

    1-ask youraelf why anyone would pay 1000′s of dolllars to lawyers rather than just produce the documents.
    2- even if he WAS born in Hawai..he may have HAD do give it up by being Indonesian citizen m( and Kenyan..which he NOW admits on his website).. since DUAL citizenship NOT allowed in Indonesia.
    he re-claimed US cit. in 80′s.. but that doesn’t allow him to be POTUS… he can be a senator..but not POTUS.
    just show the damn BC.. he was even in Hawaii this week..so get the damn BC.
